Dutch iGaming bill: the third version

The third version of the Dutch remote gaming bill and critical Council of State advice were submitted to Parliament in late July. Younes Moussaoui and Justin Franssen of Kalff Katz & Franssen provide an update and analysis for iGaming Business.

On 22 July 2014, the third version of the remote gaming bill, accompanied by very critical advice of the Council of State and the response of the State Secretary to this advice, were submitted to Parliament. The bill has been slightly adjusted in comparison to the second version of the bill published in March 2014. However, the State Secretary did not feel the need to amend several points considered by the Council of State in its review of the bill. Some of these points concern the incompatibility of the bill
with EU law, which will potentially play a significant role during the upcoming debates in Parliament.

Germany: Hans-Jörn Arp and Wolfgang Kubicki on the issue of sports betting licenses

Hesse has admitted that the Inter-State Treaty on Gambling (GlüStV) has failed – now, Minister President Albig will have to see to it that the Schleswig-Holstein model is implemented

After the admission by the Hesse Ministry of the Interior that the GlüStV does not promote the objective of curtailing illegal sports betting, Schleswig-Holstein gaming expert Hans-Jörn Arp and the head of the FDP parliamentary group, Wolfgang Kubicki, have requested that Minister President Torsten Albig now see to it that the Schleswig-Hostein model is implemented on the national level:

“The federal state assigned by the gaming committee with the issue of the 20 licenses has now given up. One cannot be state more clearly that the Treaty has failed than the Hesse Minister of the Interior in his reply to a parliamentary inquiry regarding the structure and duration of the proceedings (printed matter 19/446)”, Arp said in Kiel today (03 September). … Continue Reading

German body awards sports betting licences

Online gaming and betting provider mybet Holding has been named as one of the first group of operators to have been awarded a German sports betting licence by the Hesse Ministry of the Interior and Sport (HMDIS).

The licence, which will not be issued until September 18, will enable mybet to offer a sports betting service to players in the country.

The delay in the issuance of the licence is to allow those operators that had their applications turned down to pursue legal recourse in the hope of gaining a licence.

Dutch iGaming: A Glimpse into the Future

On 5 March 2014, a revised version of the remote gaming bill was notified to the European Commission. The revised remote gaming bill was approved previously by the Council of Ministers on 14 February 2014. Furthermore, the bill was sent to the Council of State for advice, which it rendered in the first week of May 2014. The final step is that the bill will enter the political arena, which is (at the time of writing) scheduled for July or September 2014.
